General Terms of Use – Creators

These General Terms of Use (hereinafter the "Creator Terms") define the conditions under which creators ("you", "user") can use the Treets.me platform, published by InSugarWeTrust (SARL registered in France under SIREN number 942 171 851, whose headquarters are located at 122 rue Amelot, 75011 Paris). By creating an account and using Treets.me services, you fully and unreservedly accept these conditions.

1. Access to the service

• You must be at least 18 years old
• You must provide valid identification and proof of address (handled by Stripe Connect)
• You are solely responsible for the accuracy and updating of the information provided
• Identity verification is processed by Stripe Connect in accordance with KYC (Know Your Customer) requirements

2. Content creation and publication

• You can upload up to 20 files per link
• Files must comply with applicable legislation
• Strictly prohibited: terrorist content, hate speech, violent content, child pornographic content, content inciting hatred or violence, or any illegal content
• You are solely responsible for the content published
• Treets.me does not exercise any prior editorial control, but a reactive moderation and reporting system is available
• You must own all rights to the content you publish or have express authorization to distribute it

Important notice: Once your content is purchased by a buyer, you will not be able to delete it, even if you close your account. Buyers receive a perpetual license to access purchased content. Only upload content you are comfortable with being permanently accessible to buyers.

3. Payments and commissions

• Payments are managed via Stripe Connect
• You freely set the price of your content
• A 20% commission is charged on each transaction: 10% on the creator side, 10% on the buyer side
• You will receive 80% of the set amount (excluding Stripe processing fees), according to the withdrawal terms defined by Stripe
• Payouts are subject to Stripe Connect's terms and payout schedule

4. Creator obligations

You undertake to:

• Only publish content for which you hold the rights or for which you have express authorization
• Not disclose or resell data from other users
• Not abuse the payment or withdrawal system
• Not engage in fraudulent activities or money laundering
• Comply with all applicable laws and regulations, including tax obligations
• Maintain accurate account information

5. Sanctions and account suspension

InSugarWeTrust reserves the right to:

• Suspend or delete an account without prior notice in case of non-compliance with the Terms of Use
• Inform the competent authorities in case of illegal content
• Freeze funds in case of investigation, serious dispute, or suspected fraudulent activity
• Terminate the service for users who repeatedly violate these terms

Before any definitive account deletion for policy violations, you will be notified when possible, except in cases requiring immediate action (illegal content, court order, serious fraud).

8. Intellectual property

• You retain all intellectual property rights to the content you create and upload
• By uploading content to Treets.me, you grant us a limited license to host, store, and deliver your content to authorized buyers
• You grant buyers a perpetual, non-transferable, non-exclusive license for personal use of purchased content
• Buyers may not redistribute, resell, or publicly display purchased content

9. Limitation of liability

Treets.me and InSugarWeTrust cannot be held responsible for:

• Content published by creators
• Indirect damages resulting from the use of the platform
• Service interruptions or technical issues beyond our reasonable control
• Actions of third-party service providers (Stripe, AWS)
• Disputes between creators and buyers regarding content quality or expectations

Our liability is limited to direct damages and cannot exceed the amount of commissions received from you in the 12 months preceding the claim.

10. Applicable law and jurisdiction

These Terms of Use are governed by French law. In case of dispute, the parties will seek an amicable solution. Failing that, the dispute will be submitted to the competent courts of Paris, France.

11. Modifications to Terms of Service

We reserve the right to modify these Terms of Use at any time. Significant changes will be communicated by email or through a prominent notice on the platform at least 30 days before taking effect. Continued use of the service after modifications constitutes acceptance of the new terms.

General Terms of Use – Buyers

These Buyer Terms of Use govern access to and use of the Treets.me platform by users who purchase content via a paid link generated by a creator.

1. Access to content

• You access content only after full payment via Stripe
• The content is then viewable and downloadable directly via the unique link provided
• This access is PERPETUAL: you retain lifetime access to purchased content
• You can download and store the content for strictly personal use
• This access remains valid even if the creator deletes their account
• Each link is for strictly personal use. Any public distribution, resale, or sharing is prohibited

2. Price and payment

• The price is set by the creator
• A 10% platform fee is added to the displayed price
• Payment is processed securely via Stripe
• All sales are final - no refunds are guaranteed (see section 4)

3. Lawful use and prohibitions

You undertake to:

• Not redistribute, resell, publish or publicly display the acquired content
• Use the content for personal purposes only
• Not attempt to breach security systems or circumvent access controls
• Not impersonate others to make payments or access content
• Not use purchased content for commercial purposes without explicit authorization from the creator

Any breach may result in: • Legal prosecution • Permanent access blocking • Reporting to competent authorities

4. Complaints, reports, and refunds

• You can report problematic content after purchase using our reporting system
• No refund is guaranteed by the platform - all sales are final
• Treets.me may investigate reports and take appropriate action if content is clearly illegal or violates our Terms of Service
• In exceptional cases (fraud, illegal content), refunds may be issued at our sole discretion
• For content quality disputes with creators, we encourage direct communication with the creator

5. Responsibilities and limitations

• Treets.me acts as a technical intermediary between creators and buyers
• The platform does not guarantee the quality, accuracy, or legality of content sold by creators
• You are responsible for verifying that you want to access the content before purchase
• Creators are solely responsible for the content they publish and sell
• Content previews (if any) are provided by creators and may not fully represent the purchased content

6. Your personal data

When you purchase content:

• Your payment data is processed by Stripe (our payment processor) according to their privacy policy
• Your email address and transaction history are stored by Treets.me for operational and legal purposes
• The creator whose content you purchase may have access to your email address for transaction-related purposes
• Your purchase history is retained for 10 years (legal accounting obligation)

7. Content permanence and creator account deletion

• Purchased content remains accessible to you indefinitely
• Your access is not affected if the creator deletes their account
• Downloaded content remains yours for personal use in perpetuity
• We cannot guarantee perpetual access to streaming/online viewing if our service is discontinued, but downloaded content remains yours
